3.B. Consider the Apparatus Purchase Agreement with Toyne Inc  
Discussion:
There was discussion from the Public Safety Committee about having documentation of donations to purchase the Apparatus. City Council member Anthony Fitzgerald asked if there could be a formal agreement. City Attorney Anna Burge stated that she would put together a letter of commitment for the foundations and private donors to sign. City Administrator Tom Ourada stated that this would ordinarily have to be bid even though it is being purchased with donations but once the City takes title to it there is an obligation that it has to be a bid item unless it's a sole source item and they have been in conversations about meeting the sole source requirements according to state law.
