The predominant effect of HB 3033’s change to the Texas Public Information Act’s definition of "business days" will be an occasional shortening of the time in which a district may respond to a request for public information. Governmental bodies will still operate under the normal timelines to respond to public information requests. The issue is that in some instances a
"business day" for the district may occur on a day in which the district is closed, effectively reducing the available time for a response to a public information request. To combat this
issue, the board of trustees must elect "nonbusiness days" to cover locally recognized break periods (e.g., spring break) that will otherwise be considered business days under this bill. HB
3033 became effective on September 1, 2023.

Under the bill, business days are defined as any day other than Saturday or Sunday, or a state or national holiday as defined by Texas Government Code Section 662.003. The Friday before
or Monday after a state or national holiday will not be considered a business day if the holiday occurs on a Saturday or Sunday and is observed by the district on that Friday or Monday. Yom
Kippur, Rosh Hashanah, and Good Friday will not be considered business days so long as the officer for public information of the governmental body observes the holiday.
In addition to these holidays, the board may designate up to 10 days as "non-business days" per calendar year. These must be days on which the administrative offices of the district are either
closed or operating with minimum staffing.
