7. PUBLIC COMMENT
Rationale:
The Board believes public attendance and participation, when appropriate to the business at hand, is beneficial to the work of the Board and models the importance of civic engagement and civil discourse to the community’s children, but it cannot impede the Board from completing the business of the meeting. 2. A time limit of three minutes will be allotted for any speaker unless prior to the beginning of the Public Comment agenda item, the chair sets a different reasonable time frame to be allotted for speakers in order to accommodate the number of persons who have submitted "Record of Appearance" cards. The time limit is per speaker, per meeting and may not be transferred or assigned to other speakers. 3. The chair may endeavor to organize public comment by what agenda items or other issues have been identified as topics by public speakers, adjust for the age of speakers, and/or split the Public Comment agenda item to be conducted in different positions within the Board’s Order of Business. At the discretion of the chair, the speaker may be allotted additional time. Board members may share, address or consider comments from the public during public comment, at the end of public comment or when related business is on the agenda. 4. Rationale:
The Human Resources Division also includes the Office of Risk Management. As such, in addition to the Lincoln Board of Education approving all contractual agreements with employees, all employee benefit issues, all personnel actions, and all other matters within the scope of the Human Resources Division, as part of the Human Resources Matters agenda, the Lincoln Board of Education also must approve the settlement of Workers’ Compensation claims, take action on tort claims filed against the district, and take action on all other matters within the scope of the Office of Risk Management. Explanation: That the Board is approving the Human Resources items attached with the information as presented or as on file with official district records and documents relating to each such item, or in such other form as may be approved by the Associate Superintendent for Human Resources, or the Associate Superintendent’s designee, and that the Board hereby authorizes the Associate Superintendent for Human Resources, or the Associate Superintendent’s designee, to transact and complete each such item approved hereby, and to sign, execute, and deliver necessary documents or contracts, and to take or cause to be taken any and all other action as may be necessary to complete each such item of transaction as contemplated, for and on behalf of this school district.

8.3. Option Enrollment Student Applications for 2026-27
Rationale:
On October 14, 2025, the Board adopted a resolution to accept option enrollment students for the 2025-26 school year. Applications for enrollment during the 2026-27 school year have been received and are in compliance with the Board resolution of October 14, 2025.
Explanation: The applications included in this agenda item have been examined by staff and meet one of the criteria set forth by the Board in the resolution of October 14, 2025. Staff recommends approval of the applications. Proposal: That the Board adopts the following resolution: WHEREAS, the students who have been assigned student numbers 442100, 475863, 476042, 476044 and 401679 (for purposes of confidentiality, assigned numbers are being used) meet one or more of the criteria of the Board resolution of October 14, 2025, with regard to such option students; THEREFORE, BE IT RESOLVED that the aforementioned students be accepted as option students on the condition and with the express understanding that all programs, all classes and all buildings of assignment, except as otherwise required by law, shall at all times and from time to time during attendance at Lincoln Public Schools be determined solely by Lincoln Public Schools.

9.2.1. Proposed Agreement with Transportation Employees Association for the 2026-2027 and 2027–2028 Years.
Rationale:
BACKGROUND: The District has recognized the Transportation Employees Association as the exclusive bargaining agent to negotiate salary, fringe benefits, and working conditions for members of their respective employee group. The District’s chief negotiator has met with representatives from this association to negotiate wages, hours, and other terms and conditions of employment and a tentative agreement has been reached for the 2026-2027 and 2027-2028 years. This settlement is within the parameters set by the Board of Education. A complete copy of the proposed agreement is available for review on the LPS website or at the office of the Associate Superintendent for Human Resources upon request.

9.2.2. Interlocal Cooperation Act Agreement for School Resource Officers and Threat Assessment Officer #11461
Rationale:
It is recommended that an agreement be entered into with the City of Lincoln for providing 16 School Resource Officers and a Threat Assessment Officer for the period September 1, 2026, through August 31, 2027. The agreement may be renewed for additional one-year periods upon mutual written agreement of the parties. The Resource Officers are assigned to LPS middle and high schools and the Threat Assessment Officer is assigned to the district. The Officers assist with the education of students, assist staff, and facilitate communication between LPS and LPD. School Resource Officers take appropriate law enforcement action when situations arise requiring the exercise of police authority.
Either the City or Lincoln Public Schools may terminate this agreement without cause by giving the other party sixty (60) days’ written notice. Explanation This will be an expenditure of $900,896.15. In no calendar year shall the cost per officer per year payable by LPS be greater than such cost in the prior year, compounded by a growth limitation of 7 percent per calendar year. The increase for 2026 is 6.67 percent. This expenditure will be from the General Fund. Proposal
The Board, by approving this agenda item, is also consenting to and approving this Interlocal Agreement with the City of Lincoln and any associated documents related thereto according to the terms and conditions as presented or such other or additional terms and provisions as hereinafter negotiated and approved by the Associate Superintendent for Business Affairs or a designee; and the Board is further hereby delegating to and authorizing the Superintendent, Associate Superintendent for Business Affairs or a designee to sign and deliver this Interlocal Agreement and to take or cause to be taken any and all other action and sign any other documents as may be necessary to complete the transaction and to implement and administer the Agreement on a day to day basis; to sign and deliver any renewal Agreement’s or to terminate the same as contemplated thereby and determined appropriate, for and on behalf of this school district, and unless otherwise provided by the agreement hereby designates the Director of Security, or another person as selected by the Superintendent, or the Associate Superintendent for Business Affairs or a designee from time to time as its program administrator under this agreement. |

Rationale:
The Board of Education assigns school attendance and board district areas to property newly annexed to the City of Lincoln or newly platted. This action establishes school attendance areas often prior to the sale of residential lots, allowing purchasers to know what schools their children will attend. It also establishes the LPS board districts for the board member(s) who will represent voters in these newly annexed areas.
Explanation
The City of Lincoln has annexed a parcel of land, which pursuant to state law automatically brings this property into the boundaries of Lincoln Public Schools. This property needs to be assigned attendance centers so that potential purchasers of homes in this area will know which schools they will be attending: Redtail Heights, Annexation Ordinance #21878, for the 2026-27 school year: Kloefkorn Elementary School, Moore Middle School, and Standing Bear High School The board district also needs to be assigned as follows and per the attached maps Redtail Heights (Annexation Ordinance #21878): District 5 Proposal That the Board approve the proposed attendance areas and board district assignment of the newly annexed property.

Rationale:
The Lincoln Board of Education Ad Hoc Health Insurance Committee has been reviewing current employee wellness and health insurance programs and working with an independent consultant, Gallagher Benefit Services, Inc. (Gallagher), about the possibility of developing an additional alternative health plan for the non-teaching staff of LPS.
Explanation: Gallagher has agreed to prepare and conduct a request for proposals (RFP) for an additional alternative health plan for LPS non-teaching staff. For this scope of services and deliverables under the agreement, Gallagher’s proposed compensation at an hourly rate of $400/hr. up to a maximum of $50,000. The agreement can be canceled at any time. The hourly rate will be billed for the actual time worked up to the point of completion, limited by the maximum amount or cancellation. Attached is a copy of the proposed Gallagher agreement.

Rationale:
Annually, the Board of Education evaluates the Superintendent and develops Annual Priorities for the Superintendent for the coming school year.
Explanation: Nebraska law and Lincoln Public Schools policy require the Board of Education to evaluate its Superintendent of Schools each year. Completed evaluations are confidential reports that are placed in and become part of the Superintendent's personnel file (Section 79-8,109). The 2026-27 Board of Education and Superintendent’s Annual Goals and Priorities are presented below for consideration and adoption. Progress toward each goal will be reported to the Board using identified milestones, measurable indicators, and recommended actions appropriate to the scope of the goal.

10.2.1. McKinney-Vento Homeless Assistance Grant
Rationale:
The McKinney-Vento Homeless Assistance Act is the primary piece of federal legislation dealing with the education of children and youth experiencing homelessness. The McKinney-Vento program is designed to address the problems that homeless children and youth have faced in enrolling, attending, and succeeding in school. Under this program, State educational agencies (SEAs) and Local educational agencies (LEAs) must ensure that each child and youth experiencing homelessness has equal access to the same free, appropriate public education, including a public preschool education, as other children and youth. Children and youth experiencing homelessness should have access to the educational and other services that they need to enable them to meet the same challenging State student academic achievement standards to which all students are held. States and districts are required to review and undertake steps to revise laws, regulations, practices, or policies that may act as a barrier to the enrollment, attendance, or success in school.
Explanation: The LPS Homeless Outreach Coordinator and Homeless Advocate work together and with families experiencing homelessness to arrange transportation services for children to attend school. They also work with families to provide other supports that create a more stable environment for children experiencing homelessness. LPS will use funds received through the McKinney-Vento Act to continue to support the salary of these staff and to pay transportation costs for children experiencing homelessness to attend school.
Proposal: That the Board approve the submission of the McKinney-Vento Grant application for approximately $64,000 with the final allocation to be determined by the State of Nebraska after submission and dependent upon grants awarded to other applicants. This grant requires a 100% match from Title I allocated to the district. Title I funds have been used in past years to cover the required match for this grant. The grant application will be submitted August 31, 2026. |

Rationale:
It is recommended that an agreement be entered into between Lincoln Public Schools and Blue Valley Behavioral Health to provide mental health services to Lincoln Public Schools.
Explanation
The term of this agreement begins August 12, 2026, and ends August 11, 2027. Blue Valley Behavioral Health (Lincoln, Nebraska) $572,535.00 This will an estimated expenditure of $572,535.00 from the General and Federal Funds. A complete copy of the agreement is available in the Purchasing Department. Proposal The Board, by approving this agreement with Blue Valley Behavioral Health, is approving the award, the contract documents for this project, and all associated documents related thereto according to the terms and conditions as on file with district records or such other or additional terms and provisions as negotiated and approved by the Associate Superintendent for Business Affairs or a designee, and the Board is hereby delegating to and authorizing the Associate Superintendent for Business Affairs or a designee to sign, execute, and deliver the contract documents and all such related documents, make all contract payments, and to take or cause to be taken any and all other action and sign any other documents as may be necessary to complete the transaction, and to administer, operate, and/or implement the contract and all associated documents related thereto on a day-to-day basis during this project as contemplated thereby, for and on behalf of this school district, and hereby designates the Director of Student Services, or another person as selected by the Associate Superintendent for Business Affairs or a designee from time to time as its program administrator under this agreement. |

Rationale:
The Lincoln Board of Education is authorized by state statute to hold closed sessions. Closed sessions may be held when clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual. Reasons that meet this standard include but are not limited to: (a) strategy sessions with respect to collective bargaining, real estate matters, pending litigation, or litigation which is imminent as evidenced by communication of a claim or threat of litigation to or by the public body; (b) discussion regarding deployment of security personnel or devices; (c) investigative proceedings regarding allegations of criminal misconduct; (d) evaluation of the job performance of a person when necessary to prevent needless injury to the reputation of a person and if such person has not requested a public meeting; and (e) legal advice.
Explanation
