4. Discussion and action to employ the Center for Education Law to advise the Board of Education during due process hearings.

5. Due process hearing for Alyssa Mustain:
a. The Board President shall convene the hearing, state the purpose of the hearing and introduce the parties. Upon the request of either party, the President may exclude from the hearing room the witnesses not at the time under examination,except that a party to the proceeding and his or her representative shall not be excluded. b. Opening statement by Superintendent or his designee or representative. c. Opening statement by Ms. Mustain or her designee or representative. d. Presentation of Superintendent’s evidence, followed by cross-examination of witnesses by Ms. Mustain or her designee or representative. e. Questions by Board Members. f. Presentation of Ms. Mustain’s evidence followed by cross-examination of witnesses by Superintendent or Superintendent’s designee or representative. g. Questions by Board Members. h. Presentation of rebuttal and surrebuttal evidence, as necessary. i. Closing argument by Superintendent or his designee or representative. j. Closing argument by Ms. Mustain or her designee or representative. k. Consideration and vote to go into executive session pursuant to OKLA. STAT. tit. 25,§ 307 (B) (1) & (7) to deliberate on the dismissal or not of Alyssa Mustain. l. Vote to acknowledge return to open session. m. Board President’s statement of executive session minute. n. Vote by Board to accept or reject the Superintendent’s recommendation for the dismissal of Alyssa Mustain and recitation of findings of fact upon which the decision is based. |
