5.1. Resolution Expelling a Tenth Grade Student

Description:
WHEREAS, an independent hearing officer ("IHO") held a fair and impartial hearing on the proposed expulsion of the student on February 20, 2026; WHEREAS, the IHO has issued findings of fact, conclusions, and a recommendation regarding the proposed expulsion; WHEREAS, the School Board has reviewed the IHO’s findings of fact, conclusions, and recommendation; and WHEREAS, the written notice of the proposed expulsion, the name of the student proposed for expulsion, and the findings of fact and conclusions are private educational data under the Minnesota Government Data Practices Act; NOW, THEREFORE, BE IT HEREBY RESOLVED, as follows: 1. The Board hereby accepts and adopts the IHO’s findings of fact and conclusions as the basis for its decision, with one exception. The conclusion in paragraph 32 of the IHO’s decision contains an obvious clerical error. Specifically, the date of April 17, 2025 reflects an obvious clerical error. As is evident from the remainder of the decision, the correct date is January 30, 2026. The School Board hereby corrects the obvious clerical error in paragraph 32 and adopts the IHO’s Findings, Conclusions, and Recommendation with that correction. 2. The Board hereby expels the student from the schools of NE Metro Intermediate School District 916 and from all school-related activities for a period of twelve calendar months from the date of this Resolution. 3. The Superintendent, or a designee, is directed to mail the following to the student and to the student’s parent(s): a copy of this Resolution; a copy of the IHO’s findings of fact, conclusions, and recommendation; a letter stating that the student has been expelled effective February 23, 2026, for a period of twelve calendar months; and a copy of the Pupil Fair Dismissal Act. 4. The Superintendent, or a designee, is directed to identify the alternative educational services that are available to the student during the period of expulsion, if the student wishes to take advantage of them. The letter stating that the student has been expelled should identify the alternative educational services that are available to the student. 5. The Superintendent, or a designee, is directed to make an electronic report of this expulsion to the Commissioner of the Minnesota Department of Education within thirty calendar days as required by Minnesota Statutes section 121A.53.
