Adjournment to closed session pursuant to the Texas Open Meetings Act, Texas Government Code Sections 551.071 and 551.074, for the following purposes:  

A. Consultation with the Board's Attorney

Private consultation with the Board's legal counsel regarding any item on this meeting agenda, including personnel matters, and all subjects of matters authorized by law in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Open Meetings Act.

B. Personnel

Deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of an employee or hear a complaint against an employee.

Deliberate the nonrenewal of contract of the Vice President of Academic & Student Affairs, Shelley Diviney.

Consider the President’s recommendation that the Board (i) rescind its action of February 20, 2023 (item 9.E.1) authorizing a contract for the Vice President of Academic & Student Affairs, Shelley Diviney, for the 2023-2024 academic year and (ii) approve nonrenewal of the current contract of the Vice President of Academic & Student Affairs, Shelley Diviney, in accordance with Board Policy DMAB.
