Description: This is a recommendation to revise the Student Code of Conduct as it pertains to Mandatory DAEP Placement for Possession of Vaping Devices.

Mandatory DAEP Placement for Possession of Vaping Devices

Mandatory Placement
Any student enrolled in Somerville Independent School District who is found to be in possession of an electronic cigarette, vape pen, vaping device, or any component or substance intended for use in a vaping device, whether or not the device contains nicotine or any other substance, shall be subject to mandatory placement in the District’s Disciplinary Alternative Education Program (DAEP), in accordance with House Bill 114 and applicable provisions of the Texas Education Code.
Length of Placement
The length of DAEP placement shall be determined by the District in accordance with law, Board policy, and the Student Code of Conduct.
Reduction of DAEP Placement
A student’s DAEP placement may be reduced at the discretion of the District if the student provides documented proof of meaningful participation in at least three (3) sessions of one of the following:
- A District-approved group substance abuse intervention or education program; or
- Individual substance abuse counseling provided by a licensed or otherwise qualified counselor or agency.
Documentation Requirements
Documentation must verify the student’s attendance and participation and must be submitted to the campus administration.
Purpose
This provision is intended to promote student safety, discourage the use and possession of vaping devices, and support early intervention through education and counseling, while maintaining accountability and compliance with state law.
