10.A. RESOLUTION ACCEPTING GIFTS/DONATIONS TO INDEPENDENT SCHOOL DISTRICT #162-BAGLEY
WHEREAS the following; therefore, BE IT RESOLVED by the School Board of Independent School District #162-Bagley School Board does hereby accept the following donation:

10.C.1) Resignation - Hannah Trefz, Indian Education Home School Liaison, effective 2/8/2021

10.C.2) Resignation - Doreen Zierer, Dean of Students/Athletic Director, effective June 30, 2021

10.D. Resolution Authorizing Arbitration with both Johnson Controls Inc. and Peterson Sheet Metal

Whereas,  the District’s lawsuit against JCI for faulty air handling units at the elementary school has been delayed with procedural motions by JCI pending in federal district court;
 
Whereas,  to allow the case to move forward and to combine District claims against JCI and Peterson Sheet Metal into one proceeding,  JCI has agreed to join the arbitration matter the District has brought against Peterson; and
 
Whereas,  this agreement will combine JCI with Peterson and possible other parties in a single arbitration matter and will expedite a resolution to this case, saving cost for the District.
 
Now, Therefore,  be it resolved that Superintendent Heise’s signature on behalf of the District consenting to arbitration with both JCI and Peterson is ratified and the Superintendent is further authorized to approve procedural matters relating to this arbitration while keeping the board apprised of such developments in the proceeding.
